Your use of this system (the website and its accompanying applications) constitutes your agreement to the following terms and conditions. If you do not fully accept them, your entry to and use of this system is considered unauthorized and you must stop using it immediately.

The materials and services available on this system are provided "as is", without any kind of warranty, whether express or implied.
"Camtend" shall not be liable in any way for any loss, damage, consequences or expenses caused or incurred and alleged to result from the use of this system, including, without limitation, loss of data or any error, mistake, omission, interruption or delay in this regard. The system user is fully responsible for their use of it.
"Camtend" shall not be liable in any way, including negligence, without limitation, for any direct or indirect, incidental, special or consequential damages, even in cases where "Camtend" or one of its operators has been informed of the possibility of such damages.
The user specifically acknowledges and agrees that "Camtend" is not responsible for any conduct of any user of the system.
The system contains reports, data and statistics. "Camtend" does not provide anything indicating the reliability or accuracy of any of that information, and the user bears full responsibility for relying on such statistics, data, files or other information.

Neither "Camtend" nor its owners or employees shall be liable to any user or any other party for any error, mistake, omission, interruption, deletion, defect or change in the content, data or files, or for its use, timely delivery or completeness, and we are not responsible for any failure in performance or any computer virus or communication line interruption, whatever the cause, or for any damages resulting from it.
The user agrees, as a condition of using this system, to indemnify "Camtend" for all actions, claims, losses, damages, legal liabilities and expenses (including reasonable attorney fees) arising from their use of this site, including, without limitation, any claim relating to allegations that, if proven true, would constitute a breach by the user of these terms and conditions.
This system may contain communication links or advertisements for websites owned by other parties on the network. These linked sites are not under the control of "Camtend", and it is not responsible for the contents of any of these linked sites or for any link contained in any linked site. The establishment of a link does not mean that "Camtend" endorses what the linked site represents.

The user acknowledges to the site that if they activate certain features that require storing personal files on the server, they are fully responsible for these files and they know that these files are stored on external servers.
Those responsible for operating this system also undertake to comply with the regulations and laws governing the storage of private files in the country where the system is used. In the case of using the camera to photograph employees during work or to monitor the workplace, the facility manager or those responsible for operating the program must inform the employees of this, and in this case the same laws governing the use of ordinary surveillance cameras in the country where this system is used apply.

"Camtend" provides Push Notifications and email services. The user agrees, when using these services, not to do the following:

(a) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others (such as rights of privacy and publicity);

(b) Publish, advertise or distribute any defamatory, infringing, obscene, indecent or unlawful material or information;

(c) Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the user owns or controls the relevant rights or has received all necessary consents as required by law;

(d) Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another computer;

(e) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;

(f) Falsify the origin or source of software or other material contained in a file that is uploaded;

(g) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a forum that the user knows, or reasonably should know, cannot be legally distributed in such manner.


The user acknowledges that the messages and circulars sent through Camtend and other messages exchanged between other users are not endorsed by "Camtend", and that "Camtend" should not be considered to have reviewed, scrutinized or approved such messages.

If the user grants location permission to any of the Camtend applications on their device, the geographic location of this device may be sent to the system server, as this feature is used to determine the employee location and verify their presence at their workplace. The person responsible for operating the system in the organization also acknowledges that they must use this feature only to verify the employees workplace during official working hours only, and system administrators must verify the legality of tracking employee locations in the country/state in which they work.
The Camtend system and its operators are in no way responsible for any misuse of this feature by any person.

General matters

The user is committed to providing accurate, correct and complete data about themselves according to the registration form and updating the data so that it is correct, current and complete. If the data provided by the user is incorrect, inaccurate or incomplete, the site has the right to terminate the user account and not accept their use of the service.
The user has no right to give or sell the service to any party or persons because the service is provided to them privately, and the site has the right to cancel the subscription of any user who does so without warning and without being required to refund any amount to them.
The site management has complete freedom to modify subscription prices or site services and to determine the payment method, as well as to stop/delete any/all site services or pages.
The user is not entitled to create a new account after the end of their trial subscription period - all accounts belonging to this user will be suspended if they do so.
All rights in this website, including copyright and information ownership rights and the contents of the site, are owned by the site management.

"Camtend" reserves the right, at its sole discretion, to prevent any user from accessing this site or any part of it without notice. "Camtend" is not obligated to waive any provision of these terms and conditions except what is written and signed by its duly authorized representative.



Subscription renewal

The subscription system is a renewable monthly / quarterly / annual system, and the subscription amount is automatically charged after the end of the subscription period you paid for.
If the payment process fails for any reason, the subscription will be stopped immediately.
The company data may be completely deleted within a week of not renewing the subscription.



Subscription refund

The system allows you to try it for a specific and defined period when you subscribe. During this period you can cancel the subscription, but after this period no amounts can be refunded to you under any circumstances.



Stopping the monthly / quarterly / annual payment

If you wish to stop the recurring deduction of the subscription amount, you must do so yourself from the method you used to pay (Android system - iOS system - 2CO website - Stripe... etc.), as each system has its own way of stopping the subscription. Camtend is not responsible for any amounts deducted from you if you do not stop the subscription yourself.

Disputes

If there is any dispute relating to the site or the service, you agree that any dispute shall be governed by the laws of the city of London, regardless of any conflict of legal provisions. You will resolve any claim, cause of action or dispute (referred to as a "claim") you bring against us arising from the use of this statement or Camtend exclusively before the British Magistrates Court of the city of London, and you agree to submit to the personal jurisdiction of the courts for the purpose of litigating all such claims. You agree that, regardless of any statute or law to the contrary, any claim or cause of action related to or arising from the use of the service or the terms of service must be filed within one year of the claim or the arising of the cause of action of such claim, or it shall be permanently barred.

Changes

"Camtend" reserves the right to modify any aspect of the site and any of the materials, or to limit them to certain boundaries, or to stop providing them. "Camtend" is not obliged to take the needs of any user into account in this regard. Camtend reserves the right at any time to modify this agreement and to impose new or additional terms or conditions on your use of the service. Such modifications and additional terms and conditions shall be effective immediately and incorporated into this agreement. Your continued use of the site will be deemed your acceptance of them.
