These Terms of Use ("Terms") govern your access to and use of Camtend, an employee attendance and workforce management service made up of the website camtend.com, the "Camtend Admin" and "Camtend Employee" mobile apps and related services (the "Service"), provided by Sulistar Technology Solutions Ltd, London, United Kingdom ("Camtend", "we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you confirm you are authorised to bind that company. If you do not agree, do not use the Service.
You agree not to: break the law or others' rights; upload malicious code; attempt to access other customers' data or probe, disrupt or overload the Service; reverse engineer or copy the Service; use automated means to scrape or abuse it; impersonate others or record attendance on another person's behalf; falsify attendance data, location or photos; or use messages, circulars or push notifications to send unlawful, defamatory, abusive, obscene or unsolicited commercial content or to infringe intellectual property or privacy rights.
Camtend can record attendance, photos, face recognition and device location. The Customer is solely responsible for using these features lawfully and proportionately. In particular, the Customer must:
If you operate a workplace camera or use photos for monitoring, the same laws that apply to surveillance apply to you. Camtend is not responsible for misuse of these features by any person.
Customer Data remains yours. You grant us a limited licence to host, process and display it solely to provide and secure the Service and as described in the Privacy Policy. You are responsible for the accuracy and legality of Customer Data and for uploading only files you are allowed to store. You acknowledge that files are stored on external cloud servers. You can export your records using the reports available in the Service and request deletion as described in the Privacy Policy.
The Service, including software, design, logos, text and trademarks, belongs to Camtend and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your subscription for your internal business purposes. Feedback you give us may be used without obligation to you.
We aim for reliable service but do not guarantee uninterrupted or error-free operation; maintenance, network, device, GPS or third-party failures may affect attendance recording. We may add, change or discontinue features, and update the apps; some versions may require updating to keep working.
The Service, reports and statistics are provided "as is" and "as available". Reports depend on the data entered and on device, network and location accuracy; the Customer is responsible for reviewing them before relying on them for payroll, discipline or other decisions. Camtend does not provide legal, HR or payroll advice. To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, Camtend is not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill, or for the acts of users or third parties, and our total liability arising from the Service in any 12-month period is limited to the fees you paid us in that period.
The Customer will indemnify Camtend against claims, losses and reasonable legal costs arising from the Customer's breach of these Terms or the law, its Customer Data, or its use of monitoring features (including claims by its employees).
You may stop using the Service and close your account at any time. We may suspend or terminate access, with notice where practicable, if you breach these Terms, fail to pay, misuse the Service or if required by law. On termination your right to use the Service ends; we will delete or anonymise Customer Data as set out in the Privacy Policy. Provisions that by nature should survive (ownership, disclaimers, liability, indemnity, governing law) will survive.
The Service relies on and may link to third-party services (such as Google, Apple, Stripe, maps and push notifications). Their own terms apply, and we are not responsible for them.
We may update these Terms. The date above shows the latest version; for material changes we will give notice through the Service or by email. Continued use after the effective date means you accept the new Terms.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, without affecting any mandatory consumer rights you may have in your country of residence. Please contact us first so we can try to resolve any complaint informally.
